Judge disqualifies last named plaintiff in Apple iPod case, but trial continues for now

In an unusual twist, a federal judge says a class-action lawsuit over Apple's iPods should go on even though the last remaining plaintiff named in the case was disqualified.

U.S. District Judge Yvonne Gonzalez Rogers scolded Marianna Rosen and her attorneys on Monday for not providing more complete information about the iPods she had purchased. That came after Apple lawyers argued that those models were not among those affected by the lawsuit.

But the judge also rejected Apple's argument that it's too late to add a new plaintiff's name to the case. She ordered attorneys to find a new plaintiff by Tuesday morning. Both sides estimate about 8 million people bought iPods affected by the case.
