Amgen Inc. (AMGN) will pay $24.9 million to settle allegations that it paid kickbacks to long-term care pharmacy providers in exchange for switching Medicare and Medicaid patients to its anti-anemia drug Aranesp, the Justice Department said.The settlement resolves allegations that Amgen paid off Omnicare Inc. (OCR), PharMerica Corp. (PMC) and Kindred Healthcare Inc. (KND) in the form of performance-based rebates tied to the volume of drugs purchased by the pharmacies. Such rebates are relatively common within the drug industry, but can cross the line of legality if they improperly influence prescribing decisions."By this agreement we are making important strides in holding drug manufacturers accountable for fraudulent and abusive practices," said William Nettles, U.S. Attorney for the District of South Carolina.The settlement does not require an admission of guilt on Amgen's part and the Department of Justice said that "the claims settled by this agreement are allegations only; there h...
